It’s a question that will be asked in the upcoming legal proceedings.
The Food and Drug Administration (FDA) is expected to start its final action against the drug manufacturer on Monday, at the first of three such proceedings that will take place in the US and Canada.
If passed, the action will be expected to go through in the United Kingdom, Spain, Austria, Germany, Italy, France and Sweden, as well as in the UK.
The final action will be taken by the FDA’s Drug Safety and Quality Committee (DSQC), which has to be formed for the purpose of reviewing the safety of drugs.
The case is brought by two of the world’s top drugmakers, Eli Lilly and Co and Bayer AG, alleging that the drug company failed to warn consumers of dangerous side effects associated with the use of the popular erectile dysfunction drug sildenafil.
The drug, which is called Viagra, is manufactured by Bayer’s pharmaceutical company and is used to treat erectile dysfunction, but has been linked to the death of a woman who had taken the drug.
The drugmaker has been accused of failing to warn patients of the risks of sildenafil and the other erectile dysfunction drug.
The drugmaker was fined $2 billion by the US Food and Drug Administration (FDA) in 2012, but did not disclose the fine to the FDA. Bayer is facing a $2.1 billion fine and the other two companies are facing fines of up to $7.5 billion, a charge that the company denies.
The drug company had a marketing and sales department in charge of marketing Viagra, which it said failed to warn patients about the possible risks of the drug and the dangers of heart disease.
The drugmaker has also been accused of misleading consumers into buying it without a proper prescription.
In addition to the fine, the FDA ordered to make a finding that the company failed to fully warn consumers about the dangers of the drug.

If the US Court of Appeals appeals, Pfizer will seek to have the US FDA's decision overturned.
If passed, the decision to approve the drug would be a victory for the company and will be the first in its history to impose penalties on a drugmaker for failing to warn consumers about the risk of heart attack and stroke.
